These Terms & Conditions (“Terms“) are a legal agreement between you and Vortex Lab s.r.o., a company registered in the Czech Republic (“Vortex Lab“, “we“, “us“, or “our“). By downloading, installing, accessing, or using our mobile applications and related services (collectively, the “Services“), you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services.

  1. Eligibility and Children
  • The game is rated 4+ on app stores and may be used by children with appropriate supervision by a parent or legal guardian.
  • If you are under 16 years old, you may use the game only with the permission and under the supervision of your parent or legal guardian. The adult is responsible for your use of the game, including any in‑app purchases or subscriptions.
  • If you are a parent or legal guardian and you allow a child to use the game, you agree that:
    • you are responsible for the child’s use of the Services, including any actions in the app and compliance with these Terms;
    • you have read and accepted these Terms on the child’s behalf;
    • you are responsible for all in‑app purchases or subscriptions initiated from your account or the child’s device.
  • The game does not require users to provide names, email addresses, or personal information that directly identifies them. Any analytics or crash data collected is subject to the Privacy Policy.
  1. Changes to These Terms
  • We may modify these Terms from time to time, for example to reflect changes in the Services or legal requirements.
  • When changes are material, we will show an in‑app notice or update the “Last updated” date.
  • If you continue using the Services after changes take effect, you accept the updated Terms.
  1. Description of the Services

Our Services consist of a free-to-play mobile mahjong puzzle game that may include:

  • interstitial advertisements and rewarded ads;
  • optional in‑app purchases and a monthly subscription that unlocks premium features;
  • basic analytics and crash reporting.

We may add, change, or remove features at any time, at our sole discretion.

  1. User Account and Access
  • You may use the game without creating an account.
  • If in the future an account feature is added, you must:
    • provide accurate registration information;
    • keep your login details confidential;
    • notify us immediately of any unauthorized use of your account.

You are responsible for all activity that occurs under your account or on your device.

  1. License and Acceptable Use

We grant you a limited, non‑exclusive, non‑transferable, revocable license to download and use the app on a device you own or control for your personal, non‑commercial use.

You agree that you will not:

  • copy, modify, distribute, sell, lease, translate, reverse‑engineer, or create derivative works of the app except as allowed by law;
  • remove or alter any proprietary notices, labels, or marks on the app;
  • interfere with or disrupt the Services, servers, or networks connected to the Services;
  • use the Services for any illegal, fraudulent, harmful, or deceptive purpose;
  • circumvent any technical protection measures or attempt to gain unauthorized access to the Services or restricted areas;
  • use the Services to transmit any viruses, malicious code, spyware, or other harmful content;
  • attempt to bypass or interfere with game mechanics, including cheating tools, bots, or hacking methods;
  • engage in harassment, abuse, or conduct harmful to other players or Vortex Lab;
  • use automated tools (such as scrapers or bots) to access the game except as explicitly permitted.

We may suspend or terminate your access immediately and without notice if you breach these Terms, and we may pursue additional legal remedies.

  1. In‑App Purchases and Subscriptions

The game may offer:

  • one‑time in‑app purchases;
  • a monthly subscription that renews automatically unless cancelled.

Payment and Refunds:

  • All purchases and subscriptions are processed by the Apple App Store or Google Play Store, and are subject to their payment terms, policies, and refund procedures.
  • Your subscription will automatically renew each billing period unless you cancel at least 24 hours before the end of the current period in your store account settings.
  • Prices may change; any price changes will apply on the next billing period after notice, where required by applicable law.
  • Except where required by law or platform policy, all payments are non‑refundable.
  • Vortex Lab is not responsible for chargebacks, unauthorized purchases, or fraudulent transactions; such matters are handled by the app store.
  1. Third‑Party Services

The Services display ads and may include links or integrations with third‑party services, such as:

  • advertising networks and ad mediation platforms;
  • analytics and crash reporting providers;
  • cloud infrastructure and hosting services.

Third‑party responsibility:

  • Third parties are responsible for their own content and processing of data under their own terms and privacy policies.
  • We do not control and are not responsible for third‑party websites, apps, services, or their practices.
  • Your interaction with third parties is at your own risk.
  1. Intellectual Property

All content in the Services, including but not limited to game code, graphics, artwork, text, sounds, music, characters, mechanics, and trademarks, is owned by or licensed to Vortex Lab and is protected by applicable intellectual property laws.

Except as expressly allowed in these Terms, you may not use our content without our prior written permission.

  1. Disclaimers and “As Is” Provision

The Services are provided on an “as is” and “as available” basis, without any warranties or conditions of any kind, to the maximum extent permitted by law.

Without limiting the foregoing, we do not warrant that:

  • the Services will be uninterrupted, error‑free, secure, or continuously available;
  • any defects or bugs will be corrected;
  • the Services will meet your expectations or be compatible with all devices or OS versions;
  • the game will run without crashes, glitches, or performance issues.

No Medical, Financial, or Professional Advice:

Nothing in the game, including any in‑game text, information, or features, constitutes medical, financial, legal, psychological, or other professional advice. You should not rely on the game for any such purpose.

Your Sole Remedy:

If you are not satisfied with the Services, your sole and exclusive remedy is to stop using the Services and request a refund from the app store (subject to their refund policy).

     10. Limitation of Liability

To the maximum extent permitted by applicable law, Vortex Lab and its directors, officers, employees, agents, and partners shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of data, revenue, profits, goodwill, business opportunity, or other intangible loss, arising from or in connection with your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.

Subject to the paragraph below and to the extent permitted by law, our total cumulative liability for any and all claims arising out of or relating to the Services or these Terms shall be limited to the greater of:

  • the amount you actually paid to us for the Services during the three (3) months immediately prior to the event giving rise to the claim, or

  • EUR 50.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for your statutory rights as a consumer (including any mandatory rights to a refund, repair, or replacement for defective or non‑conforming digital content).

Exceptions to limitation:

Notwithstanding the above, nothing in these Terms limits liability for:

  • death or personal injury caused by our gross negligence or willful misconduct;
  • fraud or fraudulent misrepresentation;
  • breaches of applicable consumer protection laws that cannot be excluded;
  • breaches of material terms that go to the essential purpose of this agreement.

Some jurisdictions do not allow certain limitations of liability; in that case, the above will apply to the fullest extent permitted by law.

  1. Indemnity

You agree to indemnify, defend, and hold harmless Vortex Lab and its officers, directors, employees, agents, partners, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal and attorney fees) arising out of or in connection with:

  • your misuse or violation of these Terms;
  • your misuse of the Services;
  • your violation of applicable laws or regulations;
  • your violation of any third‑party rights, including intellectual property rights;
  • any content you create or transmit through the Services (if applicable);
  • your conduct or interactions with other users.

We reserve the right to assume exclusive defense and control of any indemnified claim, and you will cooperate fully in that defense.

  1. Termination and Suspension
  • We may suspend or terminate your access to the Services at any time, with or without cause and without notice, if:
    • you breach these Terms or applicable law;
    • we determine that your use is harmful, fraudulent, or violates the rights of others;
    • we decide to discontinue or modify the Services;
    • required by legal, regulatory, or law enforcement action.
  • Upon termination, the license granted to you terminates immediately, and you must cease all use and delete all copies of the app from your device.
  • Sections on Disclaimers, Limitation of Liability, Indemnity, and Governing Law will survive termination.
  1. Governing Law and Dispute Resolution
  • These Terms are governed by the laws of the Czech Republic, without regard to its conflict‑of‑law principles.
  • If you are an EU-based consumer, you may also enjoy mandatory protections under your local law and have the right to submit complaints to your local data protection authority.
  • Dispute Resolution:
    • Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be subject to good‑faith negotiation between the parties for 30 days.
    • If negotiation fails, disputes will be subject to the exclusive jurisdiction of the competent courts of the Czech Republic.
    • You agree to submit to the jurisdiction of the Czech courts.
  1. Severability and Entire Agreement
  • If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remainder of these Terms will continue in full force and effect.
  • These Terms, together with the Privacy Policy, constitute the entire agreement between you and Vortex Lab concerning the Services, and supersede all prior or contemporaneous communications, proposals, or agreements, whether written or oral.
